TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale ("Terms") govern the purchase of products through the online stores www.steelfly.eu and www.airguntargets.eu (the "Online Store"), operated by:

(hereinafter referred to as the "Seller")

By placing an order through the Online Store, the Buyer confirms that they have read, understood and agree to be bound by these Terms.

The Seller reserves the right to amend these Terms at any time. Any amendments shall not affect orders placed before the amendments enter into force.

1. GENERAL PROVISIONS

1.1. By using the Seller's services or purchasing Products, the Buyer agrees to these Terms.

1.2. The Seller may amend, supplement or update these Terms at any time.

1.3. The version of the Terms in force at the time an order is placed shall apply to that order.

2. ELIGIBLE PURCHASERS

2.1. Products may be purchased by natural persons who are at least 18 years old and by legal entities.

2.2. By placing an order, the Buyer confirms that:

they are legally entitled to purchase and use the Products;
the purchase, import, possession and use of the Products are not prohibited in their country of residence or registration;
they will comply with all applicable laws and regulations;
they will follow all instructions, safety requirements and recommendations provided with the Products.

2.3. The Buyer is solely responsible for ensuring that the purchased Products comply with all applicable laws and regulations in the destination country.

2.4. The Seller reserves the right to refuse or cancel an order where unlawful use, possession or delivery of the Products is suspected.

3. PRODUCTS AND PRODUCT DESCRIPTIONS

3.1. Product images are provided for illustrative purposes only.

3.2. The Seller makes every reasonable effort to ensure that Product descriptions, specifications and availability information are accurate and up to date.

3.3. Actual colours, dimensions, weight and appearance may vary slightly due to manufacturing processes, material characteristics or display settings.

3.4. In exceptional circumstances, a Product may become unavailable after an order has been placed. In such cases, the Buyer will be informed and any payment received will be refunded.

4. PRICES

4.1. All prices are displayed in Euro (EUR) and include applicable taxes unless stated otherwise.

4.2. Shipping costs are displayed separately before the order is confirmed.

4.3. The Seller reserves the right to correct pricing errors. If an order has been placed at an obviously incorrect price, the Seller may cancel the order and refund any payment received.

4.4. Prices may be changed without prior notice. Such changes shall not affect confirmed orders.

5. ORDERING PROCESS

5.1. The Buyer selects Products and adds them to the shopping cart.

5.2. The Buyer provides the information required to complete the order.

5.3. Before confirming the order, the Buyer may review and correct the entered information.

5.4. An order is deemed received when the Seller sends an order acknowledgement email. The purchase contract is concluded only when the Seller confirms acceptance of the order for processing.

5.5. The Seller may refuse or cancel an order if:

the Product is unavailable;
a technical error has occurred regarding price or availability;
fraud or unlawful activity is suspected;
incorrect or misleading information has been provided;
fulfilment would violate applicable laws or regulations.

6. PAYMENT

6.1. Payment shall be made using the payment methods offered in the Online Store.

6.2. Orders will be processed only after full payment has been received.

6.3. Payment processing may be provided by third-party payment service providers.

7. DELIVERY

7.1. Delivery is available to countries listed in the Online Store.

7.2. Estimated delivery times are indicated in the Product description or during checkout.

7.3. Delivery times are estimates only and may vary due to circumstances beyond the Seller's reasonable control.

7.4. The Buyer is responsible for providing a complete and accurate delivery address.

7.5. Orders shipped outside the European Union may be subject to customs duties, import taxes and other charges payable by the Buyer.

7.6. For deliveries to the United Kingdom, the Buyer is responsible for any applicable import VAT, customs duties and governmental charges unless explicitly stated otherwise.

7.7. Risk of loss or damage passes to the Buyer upon delivery of the Products to the Buyer or a person designated by the Buyer.

7.8. Ownership of the Products passes to the Buyer only upon full payment of the purchase price.

8. INTERNATIONAL ORDERS

8.1. The Buyer is responsible for complying with all import, customs, tax and regulatory requirements applicable in their country.

8.2. The Seller shall not be liable for:

customs delays or seizures;
import restrictions or prohibitions;
additional duties, taxes or governmental charges;
refusal of delivery by customs authorities or governmental institutions.

8.3. If a shipment is returned to the Seller due to the Buyer's fault, shipping costs, customs charges and other related expenses may be deducted from any refund.

9. WARRANTY AND CLAIMS

9.1. The Buyer should inspect the Product immediately upon receipt.

9.2. Consumers are entitled to statutory remedies for non-conforming goods as provided by applicable consumer protection legislation.

9.3. Any defects, damages or discrepancies should be reported to the Seller within a reasonable period after discovery.

9.4. Consumers shall enjoy all rights granted under the applicable laws of the Republic of Latvia and relevant European Union legislation.

9.5. Where a Product does not conform to the contract, the Buyer may request:

repair of the Product;
replacement of the Product;
a proportionate price reduction;
termination of the contract and a refund where legally justified.

9.6. Claims shall be handled within the time limits established by applicable law.

9.7. The warranty does not cover:

normal wear and tear;
cosmetic wear, paint damage, surface marks and deformations resulting from the intended use of steel targets;
damage caused by improper use, misuse, negligence or failure to follow instructions;
Products modified, altered or repaired without the Seller's authorization.

10. LIMITATION OF LIABILITY

10.1. To the maximum extent permitted by applicable law, the Seller shall not be liable for indirect, incidental, special or consequential damages.

10.2. The Seller shall not be liable for losses arising from:

improper use of the Products;
normal wear and tear;
failure to follow instructions or safety requirements;
inaccurate or incomplete information provided by the Buyer.

10.3. The Seller shall not be liable for delays caused by force majeure events.

10.4. Nothing in these Terms shall exclude or limit any consumer rights that cannot be excluded or limited under applicable law.

11. FORCE MAJEURE

11.1. The Seller shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to:

natural disasters;
fire;
flood;
war;
terrorism;
strikes or labour disputes;
governmental restrictions;
transportation disruptions;
communication network failures;
internet service interruptions.

12. RIGHT OF WITHDRAWAL

12.1. Consumers have the right to withdraw from a distance contract within fourteen (14) days without giving any reason.

12.2. The withdrawal period expires fourteen (14) days after the day on which the Buyer, or a third party designated by the Buyer, acquires physical possession of the Product.

12.3. To exercise the right of withdrawal, the Buyer must send an unambiguous statement to:

12.4. The Product must be returned no later than fourteen (14) days after submission of the withdrawal notice.

12.5. The Buyer shall bear the direct cost of returning the goods unless otherwise agreed.

12.6. Refunds will be made within fourteen (14) days after receipt of the withdrawal notice. The Seller may withhold reimbursement until the Product has been returned or proof of return has been provided.

12.7. The right of withdrawal shall not apply in cases provided by law, including:

custom-made Products;
personalized Products;
perishable goods;
sealed hygiene goods after opening;
any other exceptions provided by applicable legislation.

13. PERSONAL DATA PROCESSING

13.1. Personal data is processed in accordance with the Seller's Privacy Policy and applicable data protection legislation, including Regulation (EU) 2016/679 (GDPR).

13.2. Personal data may be used for:

order processing;
delivery arrangements;
customer communication;
compliance with accounting and legal obligations.

13.4. By placing an order, the Buyer confirms that all information provided is accurate, complete and up to date.

14. INTELLECTUAL PROPERTY

14.1. All intellectual property rights relating to the Online Store and its content, including images, texts, graphics, logos, designs and Product descriptions, belong to the Seller or its licensors.

14.2. Any copying, reproduction, distribution or use of such content without prior written permission is prohibited.

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1. Any disputes between the Buyer and the Seller shall first be resolved through mutual negotiations.

15.2. If no agreement can be reached, consumers may submit a complaint to the Consumer Rights Protection Centre of Latvia (PTAC) or bring a claim before a competent court.

15.3. These Terms shall be governed by and construed in accordance with the laws of the Republic of Latvia.
